Terms of Service
EmissionsTracker Platform — carbon accounting and emissions reporting
Effective 20 August 2026
1. Acceptance of terms
By accessing or using EmissionsTracker Platform (“the Service”) you agree to be bound by these Terms of Service. If you do not agree, you may not access or use the Service. These Terms apply to all users, including visitors, registered users and organisations.
2. Service description
EmissionsTracker Platform is a carbon accounting and emissions tracking platform for organisations to measure, manage and reduce their environmental impact. The Service includes emissions data entry, reporting, analytics, team collaboration and billing management.
We reserve the right to modify, suspend or discontinue any part of the Service at any time, with or without notice.
3. User responsibilities
As a user of EmissionsTracker Platform you agree to:
- Provide accurate and complete information during registration
- Maintain the security and confidentiality of your account credentials
- Notify us immediately of any unauthorised access or security breach
- Use the Service only for lawful purposes and in compliance with applicable regulation
- Not attempt to reverse engineer, decompile or otherwise access the source code of the Service
- Not use the Service to transmit malicious code, spam or unauthorised content
- Comply with all applicable environmental, privacy and data protection obligations
4. Account requirements
To use EmissionsTracker Platform you must be at least 16 years of age, have the legal capacity to enter into these Terms, provide a valid email address for verification, and keep your account information accurate.
You are responsible for all activity under your account. Accounts are created by registration or by invitation from an organisation.
5. Subscription terms
EmissionsTracker Platform is licensed on a per-seat subscription basis. By subscribing:
- You agree to pay the applicable fees for your selected plan and licence count
- Subscriptions are billed on a recurring basis (monthly or annually)
- Plan changes take effect at the start of the next billing cycle
- Reducing licences may remove access for team members
- We reserve the right to change pricing with 30 days advance notice
6. Billing terms
- Payment: all fees are quoted in Australian dollars (AUD) and are due at the beginning of each billing period.
- Auto-renewal: subscriptions renew automatically at the end of each billing period unless cancelled.
- Failed payments: if payment fails we may retry the charge and suspend access after a grace period.
- Invoices: an invoice is generated for each billing cycle and is available in your account.
- Taxes: prices exclude applicable taxes, which are added at checkout where required by law. For Australian customers this is GST at 10%. The exact amount is determined from your billing address at checkout, and you may enter an ABN so your receipt is a valid tax invoice.
- Card processing fee: a surcharge covering the cost of accepting your card payment is shown as its own line item at checkout and on every invoice, before you confirm. It recovers our cost of acceptance and no more, and it is never applied without being itemised first. The current rate is shown on your billing page.
7. Stripe payment terms
Payment processing is provided by Stripe, Inc. By making a payment you also agree to Stripe’s Services Agreement and Privacy Policy.
- All card data is handled directly by Stripe — EmissionsTracker Platform never stores full card details.
- Refunds are processed through Stripe and may take 5–10 business days to appear on your statement.
- Disputed charges are handled through Stripe’s dispute resolution process.
8. Organisation responsibilities
Organisation owners and managers are responsible for managing team membership and role assignments, ensuring data entered by team members is accurate, maintaining subscription payment for the organisation, meeting data protection obligations for their organisation’s data, and managing invitations and removing former members promptly.
9. Emissions data and reporting
You are solely responsible for the accuracy of the activity data you enter and for any report you publish from it. EmissionsTracker Platform applies published emission factors and calculation methods to the data you supply; it does not audit your inputs, and a figure produced by the Service is not an assurance statement, a verification, or a substitute for one.
10. API usage
If the Service provides API access, you agree not to exceed rate limits or abuse the API, to keep API credentials confidential, not to use the API to compete with or replicate the Service, and to comply with all applicable documentation and usage guidelines.
11. Service limitations
The Service is provided “as is” and we do not guarantee uninterrupted or error-free operation, that the Service will meet your specific requirements, the accuracy of any emissions calculation or compliance advice, or compatibility with all devices and browsers.
We aim for high availability, but scheduled maintenance and unforeseen outages may occur.
12. Cancellation policy
- By you: you may cancel your subscription at any time from your billing settings. Access continues until the end of the current billing period.
- By us: we may suspend or terminate accounts that violate these Terms, with notice where possible.
- Data after cancellation: your data is retained for 30 days after cancellation. After that it may be permanently deleted.
13. Refund policy
- Annual plans: refund requests within 14 days of purchase are eligible for a full prorated refund.
- Monthly plans: no refunds for partial months. Cancellation takes effect at the end of the billing period.
- Service issues: if you experience significant service disruption, contact support for a credit or refund consideration.
All refund requests should be directed to [email protected].
14. Intellectual property
All content, features and functionality of EmissionsTracker Platform — including text, graphics, logos, icons, images and software — are the exclusive property of Sustainable Transport Advisory Pty Ltd and are protected by copyright, trademark and intellectual property laws.
You retain ownership of the data you input into the Service. By using the Service you grant us a limited licence to process your data solely to provide the Service.
15. Legal disclaimers
No professional advice: EmissionsTracker Platform provides tools for emissions tracking and reporting. It does not constitute legal, environmental, assurance or financial advice. Consult qualified professionals for compliance decisions.
No warranty: THE SERVICE IS PROVIDED “AS IS” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT.
Third-party services: the Service integrates with third-party providers (for example Stripe). We are not responsible for the actions, policies or availability of third-party services.
16. Termination
Either party may terminate this agreement: by you, by cancelling your subscription and closing your account; by us, for cause (a breach of these Terms) with notice, or without cause on 30 days notice.
On termination all licences granted to you cease immediately. Provisions that by their nature survive (intellectual property, disclaimers, liability) remain in effect.
17. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, SUSTAINABLE TRANSPORT ADVISORY PTY LTD SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUE, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL OR OTHER INTANGIBLE LOSSES.
Our total liability for any claim arising from or related to the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim. Nothing in these Terms excludes any right or remedy that cannot lawfully be excluded, including under the Australian Consumer Law.
18. Governing law
These Terms are governed by the laws of New South Wales, Australia. Any dispute arising from these Terms or the Service will first be addressed through good-faith negotiation and, failing that, in the courts of that jurisdiction.
19. Changes to terms
We reserve the right to modify these Terms at any time. Material changes will be communicated by email to registered users, by posting the updated Terms, and by in-app notification for significant changes. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
